PREAMBLE
These Terms and Conditions ("Terms", "Agreement") constitute a legally binding contract entered into by and between PravahsHandicrafts Private Limited, a company incorporated under the provisions of the Companies Act, 2013, having its registered office at S.L.R Nilaya, 56/3 Room No 201, 2nd Floor, Prakruthi Layout, Behind Neo Hospital, Doddathoguru Cross, Electronic City Phase-1, Bangalore, Karnataka 560100, India (hereinafter referred to as the "Company", "we", "us", or "our"), and you, the user, visitor, merchant, or customer (hereinafter referred to as "User", "you", or "your").
This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020, which require publishing the rules and regulations, privacy policy, and terms of use for access or usage of the domain name www.pravahshandicrafts.com (the "Platform").
1. DEFINITIONS
In these Terms, unless the context otherwise requires, the following expressions shall have the meanings respectively assigned to them:
1.1. "Applicable Law" means all statutes, enactments, acts of legislature or parliament, laws, ordinances, rules, bye-laws, regulations, notifications, guidelines, policies, directions, directives and orders of any Governmental Authority, statutory authority, tribunal, board, court, including but not limited to the Information Technology Act, 2000, Consumer Protection Act, 2019, Digital Personal Data Protection Act, 2023, RBI Guidelines, FEMA, and GST Laws.
1.2. "Customer" means a User who accesses the Platform and places an Order for the purchase of Products.
1.3. "Platform" means the website accessible at www.pravahshandicrafts.com, and any associated mobile applications, interfaces, or subdomains operated by the Company.
1.4. "Products" means the handmade items, home decor, furniture, traditional arts, and other goods listed on the Platform.
1.5. "Seller" / "Artisan" means independent third-party vendors, artisans, or craftsmen who list their Products for sale on the Platform.
1.6. "Payment Gateway" means third-party payment aggregators authorized by the Reserve Bank of India (RBI) utilized by the Company for processing online payments.
2. INTERPRETATION
2.1. Words denoting the singular shall include the plural and vice versa.
2.2. Reference to any law or legislation shall be construed as a reference to such law or legislation as amended, modified, or re-enacted from time to time.
2.3. Headings are for convenience only and shall not affect the interpretation of this Agreement.
3. ACCEPTANCE OF TERMS
3.1. By accessing, browsing, registering, or transacting on the Platform, you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms, along with the Privacy Policy and any other applicable policies incorporated herein by reference.
3.2. If you do not agree with any part of these Terms, you must immediately cease all access and use of the Platform.

5. ELIGIBILITY
5.1. Use of the Platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Act, including un-discharged insolvents, are not eligible to use the Platform.
5.2. If you are a minor (under the age of 18 years), you may use the Platform only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
6. MERCHANT OF RECORD
6.1. For all transactions processed on the Platform, PravahsHandicrafts Private Limited shall act as the Merchant of Record.
6.2. As the Merchant of Record, the Company is responsible for facilitating the transaction, managing the Payment Gateway integration, collecting payments from Customers, remitting taxes as applicable under the e-commerce GST framework, and managing refunds and chargebacks in compliance with the RBI Payment Aggregator Guidelines.
7. MARKETPLACE MODEL
7.1. The Company operates a managed marketplace model (intermediary) under the Information Technology Act, 2000.
7.2. The contract of sale for any Product is strictly a bipartite contract between the Customer and the respective Seller. The Company is not and cannot be a party to or control in any manner any transaction between the Platform's Users.
7.3. The Company does not implicitly or explicitly support or endorse the sale or purchase of any items on the Platform and accepts no liability for any errors or omissions, whether on behalf of itself or third parties.
8. USER REGISTRATION
8.1. To avail certain services, Users must register and create an account by providing accurate, current, and complete information, including a valid email address and mobile number.
8.2. The Company reserves the right to suspend or terminate accounts that provide fraudulent, inaccurate, or incomplete information, in accordance with our KYC and AML policies.
9. USER ACCOUNTS
9.1. You are solely responsible for maintaining the confidentiality of your account credentials (username, password, OTPs).
9.2. You agree to accept responsibility for all activities that occur under your account. The Company shall not be liable for any unauthorized access resulting from your failure to secure your credentials.
10. CUSTOMER OBLIGATIONS
10.1. Customers agree to use the Platform in good faith and for lawful purposes only.
10.2. Customers shall ensure that all payment instruments used are legally owned by them.
10.3. Customers shall not use the Platform for fraudulent transactions, money laundering, or any activity in violation of the FEMA or RBI directives.
11. PRODUCT LISTINGS
11.1. All Product descriptions, images, and specifications are provided by the respective Sellers. While the Company endeavors to ensure accuracy, it does not warrant that product descriptions are entirely accurate, complete, reliable, or error-free.
11.2. The pricing, availability, and applicable taxes for Products are subject to change without prior notice.
12. HANDMADE PRODUCT DISCLAIMER
12.1. Customers acknowledge that the Products listed are handmade, artisanal goods.
12.2. Due to the handcrafted nature of the Products, minor variations in color, texture, weave, symmetry, and finish are inherent characteristics and shall not be construed as manufacturing defects or grounds for standard returns, subject to consumer protection laws.
13. PRICING POLICY
13.1. Prices listed on the Platform are in Indian Rupees (INR) unless otherwise explicitly specified for international users.
13.2. The Company reserves the right to correct any pricing errors. In the event of a pricing error, the Company may, at its sole discretion, cancel the order and refund the transaction.
14. GST
14.1. As an e-commerce operator, the Company complies with the provisions of the Central Goods and Services Tax Act, 2017 (CGST Act).
14.2. Applicable GST (IGST/CGST/SGST) is calculated and levied based on the HSN code of the Product and the shipping destination. Tax Compliance (TCS) provisions are adhered to for Seller remittances.
15. TAXES
15.1. The User is responsible for understanding and bearing any local taxes, octroi, or state-specific levies applicable to the delivery of the goods, unless explicitly included in the checkout price.
16. INTERNATIONAL TAXES
16.1. For international shipments, pricing does not include destination country import duties, customs fees, or local taxes.
16.2. These charges are the sole responsibility of the Customer and must be paid upon delivery. Refusal to pay customs duties does not entitle the Customer to a refund.
17. ORDERS
17.1. The placement of an order by a Customer constitutes a legal offer to purchase the Product.
17.2. All orders are subject to availability and confirmation of the order price.
18. ORDER ACCEPTANCE
18.1. An order is considered accepted only when the Company issues a formal dispatch confirmation via email or SMS.
18.2. Payment gateway confirmation of funds deduction does not automatically constitute order acceptance.
19. ORDER REJECTION
19.1. The Company and/or the Seller reserves the right to reject or cancel any order for any reason, including but not limited to inventory unavailability, pricing errors, suspected fraud, or failure to pass risk monitoring checks.
19.2. In such events, a full refund will be initiated within 5-7 business days to the original payment method.
20. PAYMENT TERMS
20.1. All payments must be processed through the authorized Payment Gateways integrated into the Platform.
20.2. The Company does not accept direct bank transfers or offline cash payments outside of the authorized cash-on-delivery (COD) parameters (if offered).
21. PAYMENT GATEWAY TERMS
21.1. Transactions are processed via RBI-approved payment aggregators (e.g., Razorpay, Cashfree, PayU, Stripe).
21.2. By transacting on the Platform, you agree to be bound by the respective terms of service and privacy policies of these Payment Gateways.
21.3. The Company does not store, process, or retain any complete credit/debit card numbers or UPI PINs on its own servers.
22. RBI COMPLIANCE
22.1. The Company strictly adheres to the Reserve Bank of India (RBI) Guidelines on Regulation of Payment Aggregators and Payment Gateways (DPSS.CO.PD.No.1102/02.14.08/2019-20).
22.2. Cross-border transactions are executed in strict compliance with the Foreign Exchange Management Act, 1999 (FEMA) and the OPGSP guidelines.
23. UPI TRANSACTIONS
23.1. Unified Payments Interface (UPI) transactions are processed in real-time. Customers must ensure sufficient account balance and authorize transactions within the stipulated time limit.
23.2. The Company is not liable for transaction failures caused by NPCI network downtime or issuer bank timeouts.
24. CREDIT CARD PROCESSING
24.1. The Company supports major credit card networks (Visa, Mastercard, RuPay, Amex).
24.2. Transactions are subject to Risk Based Authentication (RBA) and 3D Secure 2.0 protocols as mandated by the RBI for domestic transactions.
25. DEBIT CARD PROCESSING
25.1. Debit card transactions are processed securely via encrypted API calls to the Payment Gateway. Users must complete two-factor authentication (2FA/OTP) for successful processing.
26. NET BANKING
26.1. Net banking facilities are provided through integration with major scheduled commercial banks. The Company accepts no liability for transaction failures occurring on the bank's portal.
27. WALLET PAYMENTS
27.1. Approved PPI (Prepaid Payment Instrument) wallets may be utilized. Usage is subject to RBI KYC guidelines pertaining to PPIs.
28. PCI DSS STATEMENT
28.1. The Platform utilizes Payment Gateways that are certified under the Payment Card Industry Data Security Standard (PCI DSS v4.0).
28.2. The Company ensures that cardholder data environment (CDE) parameters are completely isolated from its primary application servers.
29. PAYMENT SECURITY
29.1. All traffic between the Customer's browser and the Platform is encrypted using TLS 1.3 (Transport Layer Security).
29.2. Sensitive payload data is tokenized by the Payment Gateway prior to authorization.
30. FRAUD PREVENTION
30.1. The Company employs advanced, AI-driven fraud monitoring heuristics to identify velocity anomalies, IP-mismatches, and high-risk bin blocks.
30.2. Orders flagged as high-risk will undergo manual review and may require additional Identity Verification before dispatch.
31. AML POLICY
31.1. In compliance with the Prevention of Money Laundering Act, 2002 (PMLA), the Company monitors transaction volumes to prevent the platform from being utilized for money laundering.
31.2. Structured transactions designed to evade reporting thresholds will be immediately reported to the Financial Intelligence Unit (FIU-IND).
32. KYC VERIFICATION
32.1. Sellers are subject to rigorous Know Your Customer (KYC) onboarding checks, including PAN, GSTIN, and Bank Account verification via Penny Drop APIs.
32.2. Customers placing high-value orders may be required to provide officially valid documents (OVD) prior to order fulfillment.
33. SUSPICIOUS TRANSACTIONS
33.1. The Company reserves the right to place a hold on, or entirely reverse, any transaction it deems suspicious, without prior notice.
33.2. Law enforcement agencies will be fully cooperated with in the event of suspected financial cybercrime.
34. RISK MONITORING
34.1. Continuous transaction monitoring is enforced to assess the risk profile of both Customers and Sellers, evaluating chargeback ratios, refund frequencies, and delivery disputes.
35. SHIPPING POLICY
35.1. The Company acts as a facilitator coordinating with third-party logistics (3PL) partners (e.g., BlueDart, Delhivery, FedEx) for the delivery of Products.
35.2. Title and risk of loss pass to the Customer upon the Company's handover of the Product to the carrier.
36. DELIVERY TIMELINES
36.1. Domestic delivery SLAs range from 5 to 10 business days post-dispatch.
36.2. Because Products are handcrafted, an additional artisan preparation time of 2 to 5 business days is required prior to dispatch. These timelines are estimates and not guaranteed.
37. INTERNATIONAL SHIPPING
37.1. International orders are processed via authorized global carriers. Standard international delivery SLAs range from 10 to 21 business days.
37.2. The Company complies with all Indian export regulations for handicrafts.
38. CUSTOMS
38.1. International Customers are designated as the Importer of Record and must comply with all laws and regulations of the destination country.
38.2. The Company is not liable for shipments seized or delayed by customs authorities.
39. IMPORT DUTIES
39.1. The Customer bears sole responsibility for the payment of any import duties, VAT, or local taxes assessed by the destination country's customs agency.
40. TRACKING
40.1. An AWB (Airway Bill) tracking link will be provided via SMS and Email within 24 hours of the physical dispatch of the Product.
41. RETURNS
41.1. Under the Consumer Protection Act, 2019, returns are accepted within 7 days of delivery only in the case of manufacturing defects or receipt of the wrong item.
41.2. Claims of "dislike" or "slight color variation" for handcrafted items do not qualify for returns (refer to Section 12).
42. REFUNDS
42.1. Approved refunds are processed back to the original source of payment within 5 to 7 business days following the successful quality check (QC) of the returned item.
42.2. Cash on Delivery refunds are processed via NEFT/IMPS to a verified bank account matching the Customer's name.
43. CANCELLATION
43.1. Orders may be cancelled by the Customer only before the dispatch of the Product.
43.2. Once an AWB is generated and the product is in transit, the order cannot be cancelled.
44. REPLACEMENT POLICY
44.1. Replacements are offered subject to inventory availability of the exact artisanal item. If unavailable, a full refund will be provided.
45. DAMAGED GOODS
45.1. In the event of receiving damaged transit goods, the Customer must notify the Grievance Officer at support@pravahshandicrafts.com within 48 hours of delivery, accompanied by an unboxing video.
46. LOST SHIPMENTS
46.1. A shipment is considered lost if the logistics provider issues a definitive 'Lost in Transit' status. The Company will provide a full refund or replacement in such validated scenarios.
47. CHARGEBACKS
47.1. The Company maintains a zero-tolerance policy for fraudulent chargebacks.
47.2. If a Customer initiates an unjustified chargeback via their issuing bank, the Company reserves the right to suspend the user account and pursue civil/criminal legal action for recovery of funds.
48. PAYMENT DISPUTES
48.1. All payment disputes must first be raised directly with the Company's grievance desk prior to initiating a dispute with the issuing bank or card network.
49. MERCHANT EVIDENCE
49.1. In the event of a chargeback, the Company shall submit comprehensive compelment evidence to the acquiring bank, including IP logs, delivery PODs, AVS matches, and communication history, in adherence with Visa and Mastercard dispute resolution rules.
50. CUSTOMER RESPONSIBILITIES
50.1. The Customer must provide an accurate, complete delivery address and contact information. The Company is not liable for RTO (Return to Origin) caused by incomplete addresses or customer unavailability.
51. INTELLECTUAL PROPERTY
51.1. All content on the Platform, including text, graphics, logos, images, digital downloads, and software, is the property of the Company or its content suppliers and protected by the Copyright Act, 1957, and the Trade Marks Act, 1999.
52. COPYRIGHT
52.1. The compilation of all content on this Platform is the exclusive property of PravahsHandicrafts Private Limited.
52.2. Unauthorized scraping, copying, reproduction, or distribution is strictly prohibited and constitutes copyright infringement.
53. TRADEMARK
53.1. "PravahsHandicrafts" and associated logos are registered or unregistered trademarks of the Company in India. They may not be used in connection with any product or service that is not the Company's, in any manner likely to cause confusion.
54. WEBSITE CONTENT
54.1. The Company grants you a limited, non-exclusive, non-transferable license to access and make personal, non-commercial use of the Platform.
55. REVIEWS
55.1. Customers may post reviews, comments, and other content so long as it is not illegal, obscene, threatening, defamatory, or infringing on intellectual property rights.
56. USER GENERATED CONTENT
56.1. By posting content on the Platform, you grant the Company a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, and display such content globally.
57. PROHIBITED ACTIVITIES
57.1. You shall not use any automated system (spiders, robots, crawlers) to access the Platform.
57.2. You shall not attempt to gain unauthorized access to our servers, perform SQL injections, or execute DDoS attacks, which constitute offenses under Section 66 of the Information Technology Act, 2000.
58. WEBSITE SECURITY
58.1. The Company implements industry-standard security measures, including OWASP best practices and SOC2 compliant hosting architecture, to protect against data breaches.
59. COOKIES
59.1. The Platform utilizes strictly necessary, functional, and analytical cookies. By utilizing the Platform, you consent to our use of cookies as detailed in our Privacy Policy.
60. PRIVACY
60.1. The collection and processing of your data are governed by our Privacy Policy, which forms an integral part of these Terms.
61. DPDP ACT COMPLIANCE
61.1. The Company acts as a Data Fiduciary under the Digital Personal Data Protection Act, 2023 (DPDP Act).
61.2. We strictly adhere to the principles of purpose limitation, data minimization, and lawful processing based on verifiable consent.
61.3. Users retain the right to access, correct, and request erasure of their personal data by contacting the Grievance Officer.
62. DATA RETENTION
62.1. Personal and transaction data is retained only for the duration necessary to fulfill the operational purpose, or as mandated by Applicable Laws (e.g., PMLA requires retention of transaction logs for up to 5 years).
63. THIRD PARTY SERVICES
63.1. The Platform integrates third-party services (e.g., Payment Gateways, logistics, analytics). The Company is not responsible for the privacy practices or content of these third parties.
64. FORCE MAJEURE
64.1. The Company shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including acts of God, natural disasters, pandemic lockdowns, internet outages, cyber-attacks, or governmental embargoes.
65. DISCLAIMER
65.1. THE PLATFORM AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
66. LIMITATION OF LIABILITY
66.1. IN NO EVENT SHALL PRAVAHSHANDICRAFTS PRIVATE LIMITED, ITS DIRECTORS, OFFICERS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THIS PLATFORM.
66.2. MAXIMUM LIABILITY: The total cumulative liability of the Company to you for any claims arising out of a transaction shall not exceed the total value of the specific order giving rise to the claim.
67. INDEMNIFICATION
67.1. You agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers and employees from any claim, demand, damages, or legal fees made by any third party due to your breach of these Terms, or your violation of any law or rights of a third party.
68. EXPORT COMPLIANCE
68.1. International users agree to comply with all applicable export and re-export control laws and regulations, including those of the Republic of India and the destination country.
69. SANCTIONS COMPLIANCE
69.1. By transacting on the Platform, you warrant that you are not located in, under the control of, or a national/resident of any country sanctioned by the OFAC, United Nations Security Council, or the Government of India. The Company utilizes IP-geolocation and AML databases to enforce this.
70. SUSPENSION
70.1. The Company reserves the right, at its sole discretion, to suspend your access to the Platform immediately without notice if you breach any of these Terms.
71. TERMINATION
71.1. These Terms are effective unless and until terminated by either you or us. The Company may terminate this Agreement at any time and may do so immediately without notice. All clauses intended to survive termination (including Indemnification and Limitation of Liability) shall survive.
72. GOVERNING LAW
72.1. This Agreement shall be governed by and construed in accordance with the laws of the Republic of India.
73. ARBITRATION
73.1. Any dispute, claim, or controversy arising out of or relating to this Agreement or the breach thereof shall be settled by arbitration administered under the Arbitration and Conciliation Act, 1996.
73.2. The arbitral tribunal shall consist of a sole arbitrator appointed mutually by the Parties.
73.3. JURISDICTION: The seat and venue of arbitration shall be exclusively in Bangalore, Karnataka, India. The language of arbitration shall be English.
74. CONSUMER PROTECTION
74.1. Nothing in these Terms is intended to limit or exclude the statutory rights of consumers under the Consumer Protection Act, 2019, or the E-Commerce Rules, 2020.

75.1. In accordance with the Information Technology Act, 2000, and the Consumer Protection (E-Commerce) Rules, 2020, the name and contact details of the Grievance Officer are provided below:

75.2. The Grievance Officer shall acknowledge the complaint within 48 hours and redress it within 1 month from the date of receipt.
76. POLICY UPDATES
76.1. The Company reserves the right to modify, alter, or update these Terms at any time. Changes will be posted on the Platform, and the "Effective Date" at the top will be amended. Continued use of the Platform constitutes acceptance of the modified Terms.
77. ENTIRE AGREEMENT
77.1. These Terms, including all policies referenced herein, constitute the entire agreement and understanding between you and the Company and govern your use of the Platform, superseding any prior agreements, communications, and proposals.
